What is CIPA?

The Children's Internet Protection Act (CIPA) was enacted by Congress in 2000 to address concerns about children's access to obscene or harmful content over the Internet. CIPA imposes certain requirements on schools and libraries that receive discounts for Internet access or internal connections through the E-Rate program.

Key Fact

Schools that don't comply with CIPA can lose their E-Rate funding — often worth tens of thousands of dollars per year. Most districts can't afford that.

E-Rate Requirements

The E-Rate program provides discounts of 20-90% on eligible telecommunications services and Internet access. To qualify, schools must:

Adopt an Internet safety policy

Deploy technology protection measures (web filtering)

Hold at least one public hearing about the policy

File FCC Form 486 certifying compliance

Provide education about appropriate online behavior

Monitor online activities of minors

What Must Be Filtered

CIPA requires schools to block or filter Internet access to pictures that are:

Obscene

Content that meets the legal definition of obscenity (all users)

Child Pornography

CSAM — required to be blocked for all users

Harmful to Minors

Content inappropriate for those under 17 (minors only)

Internet Safety Policy Requirements

Your Internet safety policy must address:

1

Access by minors to inappropriate matter on the Internet

2

The safety and security of minors when using email, chat, and other communications

3

Unauthorized access (hacking) and other unlawful activities by minors online

4

Unauthorized disclosure of personal information regarding minors

5

Measures restricting minors' access to materials harmful to them

6

Educating minors about appropriate online behavior, including cyberbullying awareness

Frequently Asked Questions

What is CIPA?

The Children's Internet Protection Act (CIPA) is a federal law enacted in 2000 that requires schools and libraries receiving E-Rate funding to implement internet safety policies and technology protection measures including content filtering, monitoring, and education about appropriate online behavior.

Does CIPA apply to all schools?

CIPA applies to schools and libraries that receive E-Rate discounts (20-90% off internet and telecommunications). Schools not receiving E-Rate are not legally required to comply, but most still implement filtering for student safety, liability protection, and insurance requirements.

What does CIPA require schools to filter?

CIPA requires filtering of visual depictions that are obscene, contain child sexual abuse material (CSAM), or are harmful to minors. Schools must also monitor online activities of minors and educate students about appropriate online behavior including cyberbullying.

How do I prove CIPA compliance for E-Rate?

Schools certify CIPA compliance by filing FCC Form 486. You must have an adopted internet safety policy, have held a public hearing, and have technology protection measures (web filtering) deployed. Keep documentation of all three — E-Rate auditors may request it.

Is KyberGate CIPA compliant?

Yes. KyberGate provides all technology protection measures required by CIPA including content filtering with HTTPS inspection, activity monitoring with exportable audit reports, SafeSearch enforcement, and automated compliance documentation. Our SPIN number is 143064419.

What is the penalty for CIPA non-compliance?

Schools that fail to comply with CIPA can lose their E-Rate funding, which often amounts to tens of thousands of dollars annually. Some states have additional requirements that may result in loss of state technology funding as well.
